Tier II Reports / Annual Inspections


Tier II reports are required by every state.  The Tier II form provides state and local officials as well as the public with information on extremely hazardous and hazardous chemical substances present at your facility.

Annual Inspections of facilities are required by the EPA.

The United States Congress passed Title III of the Superfund Amendments and Reauthorization Act (SARA) on Oct. 16, 1986. The purpose of the Act is to provide public information about toxic chemicals used and stored, thereby raising public awareness of potential hazards and encouraging local planning for chemical emergencies with facility specific information.

Section 312, the Hazardous Chemical Inventory requires operators of sites storing hazardous materials, report that information to the state, emergency responders and emergency planning committees once a year.

Hazardous chemicals are defined as any substance for which a facility must maintain a Material Safety Data Sheet (MSDS) under the OSHA Hazard Communication Standard. All hazardous chemicals present at the location above threshold levels for a 24 hr. period must be reported unless specifically excluded under Section 311(e) of the EPCRA.
